Commercial Use Requirements Shabby Elements is commercial user friendly. We have several requirements and ask that you kindly endeavor to operate within them at all times. New Changes as of January 1 2006: As of January 1st, 2006, we have instituted a commercial fee per kit for commercial use. There is now a new item in the store called Commercial Use Permit ($10) along with instructions on how to use it. For each kit or paper pack ordered that you intend to use commercially, you will need to purchase the kit and place the Commercial Use Permit in your shopping cart as well. If you purchase three kits to use commercially, then change the quantity of the Permit in your shopping cart accordingly prior to check out. If you prefer, a Long Term Permit ($50 for six months, $100 for a year) can also be purchased, allowing you to purchase any kit or element in the store for commercial use during that period of time. A Note from the Admin: Our kits and elements are created for personal use by individual digital scrappers and are priced accordingly. The kits and elements are priced low so that stay-at-home moms and people who do not have unlimited resources can still participate in this amazing craft. We spend hours and hours on each product and the reward is not compensory, however the enjoyment goes beyond words. We feel that the new commercial prices are very fair. If the kits were intended for commercial use, they would be packaged and marketed differently and they would be priced differently, i.e. much higher. Selling our products for commercial use at the personal prices is, quite frankly, just giving them away so that others can profit off of efforts. We believe that the habit of giving things away, other than a complimentary sample, does not honor our own hard work or the craft in general. While we did consider the smaller commercial users in our new pricing structure, we do feel that our first duty is to the individual scrapper. The instructions and terms listed below still apply. You must still contact us us prior to purchasing your permit with the required information as outlined in number 1. Commercial use consists of any kind of redistribution of any product that uses any items created by Dianne Rigdon and/or any other vendor associated with the Shabby Elements Shop. 1. Prior to ANY commercial use, please contact us to be added to our commercial users database. Be prepared to indicate that you have read and agree to our commercial terms of use. Be prepared to explain exactly how you wish to use our elements as well as providing your full name and website or business information, as applicable. We reserve the right to deny or discontinue commercial authorization at any time. 2. Credit to ShabbyElements.com must always be a part of your commercial product. Add our website name to the back of a card, or printed layout or you may provide a list of credits to your customers, etc. 3. Your customer must only be provided with a flattened version of your creation, whether in print or jpg format. Providing a layered digital file or individual elements constitutes a violation of these terms and automatically voids your commercial use agreement. 4. Using our papers and elements to create a similar and/or derivative product is a violation of terms and copyright. For example, you may not use our digital papers to create other digital papers for sale. Our brushes and other elements may also not be used to create another digital scrapbooking product for sale. 5. Projects involving mass production are not allowed. Advertising, candy labels, brochures, templates of any kind, posters, and/or any other printed or online use resulting in more than 25 views or copies per project are not allowed. Special consideration may be given to non-profit projects. Additional charges for commercial use will be decided on a case by case basis.
FILE SHARING and/or HOT LINKING will not be tolerated. Sharing copyrighted files, even freebies without the creator's permission is against the law. Please forgive the strong wording in regard to file sharing, but unfortunately, a selfish thoughtless few make it difficult for everyone else. One bad apple doesn't spoil the whole bunch, but it sure does make life stinky. :-) Terms subject to change without notification.
